When a person gets arrested it creates great shock, trauma and fear for the person arrested and for his or her family and loved ones. Here is how the typical process works and here is what the firm of Fountain & Hattersley can do to help you get through your experience with the criminal justice system:

1. When a person is arrested he or she goes to jail. The first challenge is to get the arrested person released from jail and custody. Ray Fountain and Patricia Hattersley can guide you through the process of posting bail, getting the bail lowered, and, sometimes even getting a client released from jail without having to post the expensive bail bond premium, which usually is 10% of the amount of the bond. For example, it could cost $5,000.00 to get a person out of jail on a $50,000.00 bond. If Fountain & Hattersley can get the client released from jail without having to post a bond, then the family saves the money that would otherwise have to be paid to the bail bondsman.

2. If the defendant is released from custody then there are court appearances set at specific times in the future.

If it is a misdemeanor crime then there is usually a pre-trial settlement conference set. At this conference Fountain & Hattersley will attempt to negotiate a plea bargain which is satisfactory to the client. If the case cannot be settled then the case will be set for trial. This is where the experience of Fountain & Hattersley becomes invaluable. Both lawyers have tried many, many jury cases over the years and have the skills to give the client a superior and quality defense.

If the case is filed as a felony then there is usually a preliminary hearing conducted. If the judge believes that the defendant may have committed the alleged crime or crimes then the defendant will be held to answer to another Superior Court. The experience and skill of Fountain & Hattersley will then be used to file the appropriate legal motions and/or to negotiate a settlement of the case short of trial. If all else fails, then the case would ultimately have to be resolved by way of a jury trial. Here again, the experience and skill of Ray Fountain and Patricia Hattersley as trial lawyers will come into play for the benefit of the client.

3. If the client remains in custody until his or her case comes to a conclusion, the lawyers at
Fountain & Hattersley will visit the client in jail and keep the client (and family) informed at all times about the status and progress of the case.

4. JUVENILE CASES: If the client is a minor and the case is filed in the Juvenile Court, then the case will be assigned to attorney Patricia Hattersley. Ms. Hattersley has over 20 years of experience in defending Juvenile Court matters. She has an excellent working relationship with the prosecutors and judges who work in the Juvenile Court system and she can get favorable results in these type of cases.

Fees

The legal fees in most of our cases are paid on a "flat fee" basis rather than on an "hourly" basis. Most of our clients seem to prefer being quoted a flat fee so they know exactly what the criminal defense will cost them for their case. On occasion we do bill on an hourly basis and the hourly rate varies between $300.00 and $400.00, depending upon the complexity of the case.

We are aware of what attorneys in our area charge for similar cases and we try to be very fair and competitive in our fee quotes.

In the typical case our firm gets a reasonable up-front retainer. It is sometimes possible that part of the fee can be paid in installments as specified in the Retainer Agreement and as agreed to between client and attorney. We also accept Visa, MasterCard, American Express and Discover Card as a means of paying legal fees.
